The mandate of the Disciplinary Council is to hear any complaints made by the Syndic, the Assistant Syndic or by any other individual concerning a dentist following a breach of the Professional Code, the Dental Act, the Code of ethics of dentists or regulations adopted pursuant to these laws.

The Disciplinary Council is composed of the chair, a lawyer appointed by the government, and 23 dentists appointed by the Ordre des dentistes du Québec’s Board of Directors. The Council sits by division composed of three members, i.e., the chair and two dentists.

The roll of hearings is posted at the Ordre des dentistes du Québec’s head office at least 10 days before the date set for the hearing. All hearings are public unless the Disciplinary Council orders a closed session. The roll of disciplinary hearings indicates the identity of the dentist, the nature of the complaint, the date, time and location of the hearings. This page also provides the online roll of hearings schedule. Before attending, however, we recommend that you check to see if there have been any changes, by consulting the roll of hearings schedule.

Unless otherwise ordered, it is possible to have access to the documents contained in the disciplinary file, including the complaint, as of the first day of the hearing.

The decisions rendered by the Disciplinary Council since June 2001 are now accessible on the SOQUIJ site at http://citoyens.soquij.qc.ca or on the Canadian Legal Information Institute’s CanLII site at http://www.canlii.org/en.

Please note that the Disciplinary Council’s decisions may be appealed at the Professions Tribunal or judicially reviewed and may not, therefore, be final.

REMOTE HEARINGS

Videoconference hearings via the TEAMS platform remain public. Nature de la plainte : Entre le ou vers le 28 juin 2023 et novembre 2023, exerçant sa profession à St-Jean-sur-Richelieu, a recommandé un traitement sans avoir une connaissance suffisante des faits qui le justifiait et a procédé au traitement, le tout en contravention aux normes scientifiques généralement reconnues en médecine dentaire, a omis à son devoir d’information, a omis de consigner au dossier dentaire les informations requises, a permis ou toléré qu’une personne non-membre de l’Ordre des dentistes, procède à des actes de médecine dentaire réservés aux dentistes et a versé une partie de ses honoraires à une personne non membre de l’Ordre des dentistes du Québec, contrevenant aux articles 3.01.03, 3.02.03, 3.02.04, 3.02.05, 3.05.02, 3.05.05 (2e), 3.05.07 et 4.02.01 g) et u)du Code de déontologie des dentistes, à l’article 16 du Règlement sur la tenue des cabinets et des dossiers et la cessation d’exercice des membres de l’Ordre des dentistes du Québec et à l’article 59.2 du Code des professions.
